CLASS 9 ANNUAL AFFIDAVIT

Before you begin, please make sure you have the following required items::
  • Your Class 9 Control Number
  • The Property Address.
  • The PIN (search for it by address here).
  • The name of and valid e-mail address as the authorized agent or owner filing this affidavit.
  • Curent Class 9 Rental Information/Tenant Household Income Report Form for the property as either a Word (.doc or .docx), PDF (.pdf), or as an Excel (.xls or .xlsx) document. (Sample Report Form here)
Note: Additionally, you must select whether there has or has not been a change of ownership, and whether or not the applicant is required to pay a living wage, in order to be considered for the property's incentive.
As the owner of a property in the Cook County Class 9 Program, you are required to file an annual affidavit with the Cook County Assessor’s Office. Please complete the affidavit and include all Permanent Index Numbers participating in the program.
The deadline for returning the affidavit is August 30, 2023.*
Failure to file a completed affidavit, with the correct information by the required deadline, may result in the removal of the property from the Class 9 program.

I, as the owner or agent of the subject property, swear that the following is true and correct:

  1. The subject property is in compliance with local building codes, or if there are no local building codes, Housing Quality Standards, as determined by the United States Department of Housing and Urban Development. If the property was found not to be in compliance with applicable building, safety and health codes since the property was admitted into the program, I have attached written evidence that any violations have been cured and the relevant government agency has confirmed that the building is now in compliance with the applicable building, safety and health codes.
  2. Attached is a complete Class 9 Rental Information/Tenant Household Income Report Form which identifies the affordable units in the residential real property and includes household income information. I attest that the affordable units are comparable to the market rate units in terms of unit type, number of bedrooms per unit, quality of exterior appearance, energy efficiency, and overall quality of construction.

    Please note: Only Word (.doc, .docx), PDF (.pdf) or Excel (.xls, .xlsx) documents will be accepted.

  3. I have obtained Class 9 Rental Information/Tenant Household Income Report Forms for each designated Class 9 unit and such forms will be retained for the entire period that the subject property is eligible and receives Class 9 designation. Said certifications will be made available to members of the Cook County Assessor's Office for inspection and review.
  4. I attest that these rents do not exceed the maximum rents allowable for the area in which the residential real property is located.
  5. If applicable, attached is documentation verifying Section 8 Housing Assistance for those Section 8 units which qualify as Class 9 units during the year in question.
  6. Rents for at least thirty-five percent (35%) of the units at the subject property have not, and will not exceed the applicable Class 9 Affordable Rents for the calendar year in question. (See Class 9 Rent and Tenant Income Schedule here.) Or rents for at least thirty-five percent (35%) of the units at the subject property are for units occupied by households receiving housing assistance under Section 8 of the United States Housing Act of 1937 as amended.
  7. Total household income for all Class 9 units at the subject property has not, and will not exceed the applicable Class 9 maximum income levels for the calendar year in question. (See Class 9 Rent and Tenant Income Schedule here.)
  8. During the calendar year in question, I delivered or mailed written notice of the current permissible Class 9 affordable rental levels and income levels to those tenants occupying the Class 9 affordable rents.
  9. There has: been a change of ownership of the subject property since it qualified for the Class 9 incentive.

I have reviewed the Code of Ordinances of Cook County, Chapter 34, Article IV, Division 1, Section 34-121 and The Cook County Living Wage Ordinance, Sec. 34-160 et seq., as amended (the “Ordinance”) (see text of Ordinance here compliance with the above referenced Cook County Living Wage Ordinance, due to one of the following options (check as appropriate):
